1. Acceptance of Terms

By accessing or using the AWSYS.CO URL shortening service ("Service"), operated by Alpha Wave Systems SA de CV ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not access or use the Service.

Important Notice:

We reserve the right to modify these Terms, our Privacy Policy, pricing, features, or any aspect of the Service at any time and at our sole discretion. Changes will be effective immediately upon posting to our website. Your continued use of the Service after any modifications constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically for changes.

2. Service Description

AWSYS.CO provides a URL shortening platform that allows users to:

  • Create shortened URLs from long URLs, with optional custom slugs
  • Track detailed click analytics including geographic location, device type, and referrer
  • Generate QR codes for shortened URLs with customizable styling
  • Configure custom branded domains via DNS/CNAME verification
  • Protect links with passwords, expiration dates, maximum click caps, or geo-blocking rules
  • Organize links into folders and saved views
  • Create bulk links programmatically
  • Access the Service via REST API (Pro/Builder plans) and MCP server (all plans)
  • Configure webhooks for link events (paid tiers)
  • Participate in affiliate programs (where available)

Feature availability varies by subscription tier. We may add, modify, or remove features at any time with reasonable notice.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any information that changes
  • Accept responsibility for all activities under your account
  • Not share your account credentials or API/MCP keys with unauthorized parties

You must be at least 16 years old to create an account.

4. Subscription Plans and Payment

4.1 Plans

We offer Free, Pro, Builder, and Enterprise subscription plans with varying features and limits. Plan details and pricing are available on our website and may change with 30 days' notice.

4.2 Billing

Paid subscriptions are billed monthly or annually in advance through Stripe. You authorize us to charge your selected payment method for recurring subscription fees. Any usage-based overages (where applicable) are calculated and billed at the end of each billing cycle.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you retain access to paid features until that date. No refunds are provided for partial months or unused portions of an annual subscription.

Custom domain add-ons are cancelled effective immediately upon removal from your account. Any pro-rated credit for unused custom domain periods is at our sole discretion.

4.4 Price Changes

We may change subscription prices with 30 days' prior notice by email or in-app notification. Continued use after the effective date of a price change constitutes acceptance.

5. Fair Use Policy

While paid plans offer "unlimited" link creation, this is subject to our Fair Use Policy designed to ensure service quality for all users:

5.1 Daily Link Creation Limits

To maintain service quality, link creation is limited to:

  • Free: 25 links per day
  • Pro: 500 links per day
  • Builder: 2,000 links per day
  • Enterprise: 10,000 links per day (or as agreed)

5.2 Monthly Tracked Click Limits

Click analytics recording is subject to monthly soft caps per tier. When the cap is reached, redirects continue to function normally but click data is no longer recorded until the next billing period. Caps reset monthly.

  • Free: 1,000 tracked clicks/month
  • Pro: 50,000 tracked clicks/month
  • Builder: 500,000 tracked clicks/month
  • Enterprise: Unlimited

5.3 Fair Use Expectations

"Unlimited" means reasonable use for legitimate business purposes. It does not cover:

  • Automated bulk link creation without prior written approval
  • Creating multiple accounts to circumvent per-account limits
  • Reselling or white-labeling the Service to third parties without a commercial agreement
  • Any use that degrades service performance or availability for other users

6. Prohibited Uses

You may NOT use the Service to:

  • Create links to malware, viruses, ransomware, or any malicious software
  • Engage in phishing, credential harvesting, or any fraudulent activities
  • Distribute spam, unsolicited commercial messages, or abusive bulk communications
  • Link to illegal content, promote illegal activities, or facilitate harm to others
  • Link to content that violates intellectual property rights
  • Harass, threaten, abuse, or harm any individual or group
  • Distribute pornographic or sexually explicit material involving minors
  • Use shortened URLs as vectors for Server-Side Request Forgery (SSRF), port scanning, internal network probing, or any attempt to discover or access internal infrastructure
  • Perform automated abuse, credential stuffing, scraping, or systematic exploitation of the Service
  • Engage in link farming — creating large numbers of links primarily to generate artificial traffic or inflate analytics
  • Circumvent or attempt to circumvent rate limits, daily creation limits, click caps, or any other usage restriction
  • Interfere with, disrupt, or attempt to reverse-engineer any component of the Service
  • Attempt to gain unauthorized access to our systems, other users' accounts, or any related infrastructure
  • Violate any applicable local, national, or international laws or regulations

Violation of these prohibitions may result in immediate account suspension or termination without prior notice and without refund of any prepaid fees. We reserve the right to report violations to appropriate law enforcement authorities.

7. Custom Domains

Certain paid plans allow you to use your own domain name ("Custom Domain") with the Service. By configuring a Custom Domain, you agree to the following:

7.1 DNS Configuration Responsibility

You are solely responsible for configuring and maintaining the correct DNS records, including CNAME records, as required by the Service. We are not responsible for any downtime, misdirected traffic, or data loss caused by incorrect DNS configuration.

7.2 Domain Ownership and Legal Compliance

You represent and warrant that you own or have the legal right to use the Custom Domain. You are responsible for ensuring that use of your Custom Domain, and the content served through it via the Service, complies with all applicable laws and does not infringe any third-party rights.

7.3 Immediate Deactivation

We reserve the right to deactivate any Custom Domain immediately and without prior notice if it is used to serve malicious, illegal, or abusive content, or if we receive a valid legal demand requiring removal. Deactivation does not entitle you to a refund of any Custom Domain add-on fees.

8. API Access and MCP Server

All accounts may access the MCP (Model Context Protocol) server for AI agent integration. Pro and Builder accounts additionally access the Service via REST API. Each plan's tool access is limited to the features included in that plan.

8.1 API Key Security

API keys and MCP server credentials grant programmatic access to your account and the Service. You are solely responsible for keeping your API keys confidential. You must not expose API keys in client-side code, public repositories, or any location accessible to unauthorized parties. We are not liable for any unauthorized use of your account or data resulting from a leaked or compromised API key.

8.2 Rate Limits

API access is subject to rate limits that vary by subscription tier. Exceeding rate limits will result in temporary request throttling (HTTP 429). Systematic attempts to circumvent rate limits — including distributing requests across multiple accounts or API keys — constitute a violation of these Terms and may result in account suspension.

8.3 API Use Restrictions

You may not use the API or MCP server to build a competing URL shortening service, resell API access, or otherwise redistribute programmatic access to the Service without a written commercial agreement with us.

9. Content Responsibility

You are solely responsible for the URLs you shorten, the destinations they resolve to, and any content accessible through links you create. We do not pre-screen content but reserve the right to:

  • Remove or disable any shortened URL that violates these Terms at any time without notice
  • Cooperate with law enforcement and regulatory authorities regarding illegal or harmful content
  • Report violations to appropriate authorities
  • Display safety warnings to users visiting links we have flagged as potentially malicious

10. Service Availability and Maintenance

We strive to maintain high availability but provide no uptime guarantee for Free and Pro plans. The Service is provided "as is" without warranty of any kind.

  • Maintenance windows: We may take the Service offline for scheduled or emergency maintenance at any time, with or without advance notice. Active user sessions may be invalidated during maintenance.
  • Feature changes: We may modify, limit, or discontinue features with reasonable notice except where security or legal requirements necessitate immediate action.
  • Emergency suspension: We may suspend the Service or specific accounts immediately in response to security incidents, legal demands, or abuse.

Enterprise SLA: Customers on Enterprise plans may be entitled to a separate Service Level Agreement as specified in their Enterprise agreement. In the absence of a signed Enterprise SLA, no uptime guarantee applies.

11. Intellectual Property

The Service, including its design, software, features, and content (excluding user-generated content), is owned by Alpha Wave Systems SA de CV and protected by applicable intellectual property laws.

You retain ownership of the URLs and content you submit. You grant us a limited, non-exclusive license to process, store, and transmit your content solely as necessary to provide the Service. This license terminates when you delete the relevant content or close your account.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill
  • Our total cumulative liability is limited to the amounts you paid us in the 12 months preceding the claim
  • We are not responsible for the content of destination URLs or any harm arising from visiting those destinations
  • We are not liable for service interruptions, data loss, or analytics data gaps caused by maintenance, infrastructure outages, or events outside our reasonable control
  • We are not liable for unauthorized access to your account or data resulting from your failure to keep credentials or API keys secure

13. Indemnification

You agree to indemnify and hold harmless Alpha Wave Systems SA de CV and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) the content of any URLs you create or the destinations they resolve to; (d) your breach of any applicable law; or (e) any claim that your Custom Domain or its use infringes a third party's rights.

14. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for:

  • Violation of these Terms or any applicable policies
  • Fraudulent, abusive, or illegal activity
  • Non-payment of fees
  • Extended periods of inactivity (Free accounts inactive for more than 12 consecutive months)
  • Conduct that we determine, in our sole discretion, is harmful to other users, third parties, or our business
  • At our sole discretion, for any reason or no reason, at any time

Important:

Alpha Wave Systems SA de CV reserves the absolute right to terminate any user account at any time, for any reason, without prior notice and without obligation to provide explanation. Termination for violation of these Terms does not entitle you to a refund of any prepaid fees.

Upon termination:

  • Your right to use the Service ceases immediately
  • Your shortened URLs and Custom Domain associations may be deactivated without notice
  • No refunds will be provided for any prepaid fees, including partial subscription periods
  • We may delete your account data in accordance with our Privacy Policy

You may terminate your account at any time by using the account deletion feature in Settings or by contacting support. Voluntary termination does not entitle you to any refund of prepaid fees.

15. Governing Law and Disputes

These Terms are governed by the laws of Mexico, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Guadalajara, Jalisco, Mexico, and you consent to the personal jurisdiction of such courts.

Before initiating any legal proceeding, you agree to attempt resolution through our customer support for at least 90 days.

16. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy and any applicable Enterprise agreement, constitute the entire agreement between you and us regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in full force and effect.
  • No Waiver: Failure to enforce any right or provision does not constitute a waiver of that right or provision.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Force Majeure: We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, internet outages, or third-party infrastructure failures.
