1. Acceptance of Terms

By accessing or using the awsys.co URL shortening service ("Service"), operated by Alpha Wave Systems SA de CV ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not access or use the Service.

Important Notice:

We reserve the right to modify these Terms, our Privacy Policy, pricing, features, or any aspect of the Service at any time and at our sole discretion. Changes will be effective immediately upon posting to our website. Your continued use of the Service after any modifications constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically for changes.

2. Service Description

awsys.co provides a URL shortening service that allows users to:

  • Create shortened URLs with custom slugs, expiry, password protection, geo-blocking, and click caps
  • Track click analytics (geo, device, referrer) per tier retention window
  • Generate QR codes for shortened URLs
  • Register and manage custom branded domains (DNS verification required)
  • Organize links into folders and saved views
  • Receive click-event webhooks and export data as CSV
  • Create links in bulk and via REST API or MCP server (Pro/Builder plans)
  • Participate in affiliate programs (Builder/Enterprise plans)

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any information that changes
  • Accept responsibility for all activities under your account
  • Not share your account or API keys with others

You must be at least 16 years old to create an account.

4. Subscription Plans and Payment

4.1 Plans

We offer Free, Pro, Builder, and Enterprise subscription plans with varying features and limits. Plan details and pricing are available on our website.

4.2 Billing

Paid subscriptions are billed monthly in advance through Stripe. You authorize us to charge your selected payment method for recurring subscription fees. Usage-based overages (tracked clicks above your plan limit) are billed automatically at the end of each billing cycle at the rate specified on the pricing page. Custom domain add-ons are billed as Stripe subscription items and are charged separately from your base plan.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation of your base plan takes effect at the end of the current billing period. Custom domain add-ons are cancelled and the domain deactivated when you remove the domain from your account; any prorated amount is credited per Stripe's standard policy. No refunds are provided for partial months of the base subscription.

4.4 Price Changes

We may change subscription prices with 30 days' notice. Continued use after price changes constitutes acceptance.

5. Fair Use Policy

While paid plans offer "unlimited" link creation, this is subject to our Fair Use Policy designed to ensure service quality for all users:

5.1 Daily Link Creation Limits

To maintain service quality, link creation is limited to:

  • Free: 25 links per day
  • Pro: Unlimited (fair use applies)
  • Builder: Unlimited (no daily cap)
  • Enterprise: Unlimited

5.2 Monthly Tracked Click Limits

Click analytics recording is subject to monthly soft caps. Redirects always work — only analytics recording pauses when the cap is reached. Caps reset each calendar month.

  • Free: 1,000 tracked clicks/month
  • Pro: 50,000 tracked clicks/month (+$0.15 per 1,000 over)
  • Builder: 500,000 tracked clicks/month (+$0.15 per 1,000 over)
  • Enterprise: Unlimited

5.3 Fair Use Expectations

"Unlimited" means reasonable use for legitimate business purposes. It does not cover:

  • Automated bulk link creation without prior approval
  • Creating multiple accounts to circumvent limits
  • Reselling the service to third parties
  • Any use that degrades service performance for other users

6. Prohibited Uses

You may NOT use the Service to:

  • Create links to malware, viruses, or malicious software
  • Engage in phishing or fraudulent activities
  • Distribute spam or unsolicited commercial messages
  • Link to illegal content or promote illegal activities
  • Link to content that violates intellectual property rights
  • Harass, abuse, or harm others
  • Distribute pornographic or sexually explicit material
  • Use the URL shortener to perform port scanning, server-side request forgery (SSRF), or any network probing of internal or external systems
  • Engage in automated abuse, credential stuffing, link farming, or scraping at scale
  • Circumvent rate limits, click caps, or daily limits by creating multiple accounts
  • Resell or sublicense API access without a written agreement with Alpha Wave Systems SA de CV
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to our systems
  • Violate any applicable laws or regulations

Violation of these prohibitions may result in immediate account termination without refund.

7. Custom Domains

Pro, Builder, and Enterprise accounts may register custom domains to brand their short links. By registering a custom domain you agree to:

  • Warrant that you have the legal right to use the domain and that its use complies with applicable law
  • Maintain the required DNS records (TXT verification record and CNAME pointing to custom.awsys.co) for the duration of the registration
  • Accept that SSL certificates are provisioned automatically via Let's Encrypt; we make no guarantee about provisioning time
  • Accept sole responsibility for any content accessible through your custom domain

We may deactivate a custom domain immediately and without refund if it is used to serve malicious, illegal, or abusive content, or if the required DNS records are removed. Billing for the domain add-on pauses after 3 days of missing CNAME records and resumes if the records are restored.

8. API Access and MCP Server

Pro and Builder accounts may access the Service programmatically via REST API and, on Builder, via the MCP (Model Context Protocol) server for AI agent integration.

  • API key security: You are solely responsible for keeping your API key confidential. We are not liable for unauthorized use resulting from a leaked or compromised key. Regenerate your key immediately if you suspect compromise.
  • Rate limits: API usage is subject to hourly and monthly limits per your plan. Distributing a single API key across multiple users or systems to circumvent per-account limits is prohibited.
  • MCP server: The MCP server allows AI agents to act on your behalf. You are responsible for the actions taken by any AI agent using your API key.
  • No resale: Reselling or sublicensing API or MCP access to third parties requires a separate written agreement.

9. Content Responsibility

You are solely responsible for the URLs you shorten and the content they link to. We do not pre-screen content but reserve the right to:

  • Remove or disable any shortened URL that violates these Terms
  • Cooperate with law enforcement regarding illegal content
  • Report violations to appropriate authorities

10. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by Alpha Wave Systems SA de CV and protected by intellectual property laws.

You retain ownership of your content but grant us a license to host and process it as necessary to provide the Service.

12. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranty of any kind.

  • Maintenance: We may activate maintenance mode with or without prior notice. During maintenance, active user sessions may be invalidated and users redirected to a maintenance page.
  • No SLA for Free and Pro: Free and Pro plans are provided on a best-effort basis with no uptime guarantee. Enterprise SLA requires a separate signed agreement.
  • Builder plan: Best-effort availability; no formal SLA unless negotiated separately.
  • Modify or discontinue features with reasonable notice
  • Suspend service due to security concerns or legal requirements

Force Majeure: We are not liable for service interruptions caused by circumstances beyond our reasonable control, including but not limited to internet outages, third-party service failures (Stripe, Google Cloud, Firebase), natural disasters, or government actions.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability is limited to the amount you paid us in the 12 months preceding the claim
  • We are not responsible for the content of destination URLs
  • We are not liable for service interruptions or data loss

14. Indemnification

You agree to indemnify and hold harmless Alpha Wave Systems SA de CV and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

15. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for:

  • Violation of these Terms or any applicable policies
  • Fraudulent, abusive, or illegal activity
  • Non-payment of fees
  • Extended periods of inactivity
  • Conduct that we determine, in our sole discretion, is harmful to other users, third parties, or our business interests
  • At our sole discretion, for any reason or no reason, at any time

Important:

Alpha Wave Systems SA de CV reserves the absolute right to terminate any user account at any time, for any reason, without prior notice and without obligation to provide explanation. This includes, but is not limited to, accounts that we believe violate our Terms, pose security risks, or negatively impact our Service or other users.

Upon termination:

  • Your right to use the Service ceases immediately
  • Your shortened URLs may be deactivated without notice
  • No refunds will be provided for any prepaid fees, including partial subscription periods
  • We may delete your account data in accordance with our Privacy Policy

You may terminate your account at any time by contacting support or using the account deletion feature in Settings. Voluntary termination does not entitle you to any refund of prepaid fees.

16. Governing Law and Disputes

These Terms are governed by the laws of Mexico, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Guadalajara, Jalisco, Mexico, and you consent to the personal jurisdiction of such courts.

Before initiating any legal proceeding, you agree to attempt resolution through our customer support for at least 90 days.

17. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • No Waiver: Failure to enforce any right does not waive that right.
  • Assignment: You may not assign your rights under these Terms without our consent.
